Downtown Utica property owners get offer letters from MVHS

Just two days after Christmas the Compassion Coalition, on Lafayette Street in Utica, got their offer from MVHS for their property, which is in the downtown hospital zone.

UTICA - Just two days after Christmas the Compassion Coalition, on Lafayette Street in Utica, got their offer from MVHS for their property, which is in the downtown hospital zone.

"We are 99% positive it was a mistake, due to the very low offer to use eminent domain to take our 30,000 square foot property," reads a post on the Coalition's Facebook page.

"I don't believe the appraisal was a mistake. I do think that he probably has an opinion of whether or not the amount was the correct amount based on his valuation of his own property," says MVHS Executive VP and Chief Operating Officer Bob Scholefield.

Scholefield says 35 of 46 letters have gone out; 11 appraisals had to be modified after questions from the NYS Health Department and the state dormitory authority. Scholefield says response to the letters has been positive.

"More on the positive, fewer on the negative," said Scholefield. "Willing to sell and asking just a few clarification questions."

The Compassion Coalition's Facebook post goes on to say that they couldn't move to a facility 1/4 of their current size with what MVHS is offering. Scholefield says property owners who are unhappy with their appraisals have recourse.

"If there is maybe something that's included in the appraisal that maybe we didn't consider appropriately, or the appraisal company didn't consider appropriately and there's details that need to be added to enhance that, absolutely. The attorneys would be more than happy to meet with them and take that into consideration."

Hospital attorneys have said that roughly 80% of property value disputes are settled without invoking eminent domain, but if it does come to that, it wouldn't be MVHS initiating the proceedings.

"We would have to make them an offer, they would have to decline the offer and then we would work through a designated government agency to start moving forward."
