In what you could consider an upset out of yesterday's primaries, current Oneida County Clerk, Richard Allen, lost to Kirkland Town Supervisor, Annette Foley. In the Republican race, Foley took 51% of the vote. Allen took 49%. However, Allen tells NEWSChannel 2, he's not out of the race, yet. 

Allen will be on the ticket under the Working Families line in the November election. But, he's not convinced he's lost the Republican primary, yet. Allen says the votes are too close to call, and he wants to see the final results of last night's votes. On top of that, absentee ballets still need to be counted. With those two factors combined, Allen feels the results could sway to his favor.

"There have been other cases in the past year where there has been a thousand vote shift from what they reported that night. A thousand votes would put me over by quite a bit. That may not happen, but lets see what happens at this point in time," says Allen.

You could say it was a controversial race. During the campaign, Allen and Foley battled over posting public information. Allen says 15 other counties in New York State post information like deeds online, but Foley slammed Allen's choice.

"My message is I'm opposed to personal information being put on the internet, and I think a lot of people feel the same way," says Annette Foley. "I think that was the key to people taking a look to see who is Annette Foley and for what does she stand?"

Allen doesn't regret his position. In the meantime, it won't be until the end of the week that the County Board of Elections start going over the votes in the clerk's office. Whether he's under the Republican or Working Families ballet, Rick Allen doesn't plan on running an aggressive campaign. He says he doesn't want to be considered a "spoiler."
