Avoiding predatory lending

In a time where the word "foreclosure" is used in everyday conversation, local homeowners need to be smart when choosing a mortgage lender.

The HomeOwnership Center is dealing with a case right now where a North Utica family has been paying off a loan for 18 years...or so they thought!

"These things can happen just because we are just not as informed as we probably should be about a very complicated process," said Janice Forte, executive director  of the HomeOwnership Center.

This North Utica family, whose name is being kept confidential, bought their home in 1990 for $79,000. Both the husband and wife work full time jobs and managed a $900 monthly payment. Now, 18 years later, they still owe $77,000 on the home!

"There are a lot of institutions outside of the area that don't hold new york state standards," Forte said.

And that's exactly what happened!

The HomeOwnership Center says the families loan was sold twice -now in the hands of an out of state lender that according to the agency will not return phone calls.

"You really need to know what you're getting yourself into," Forte said. "Have a representative there that will represent you, Not the bank's interest, not the real estate persons interest...your interest at the end of the day."

Turns out the family was paying the interest and the escrow but not on the principal at all. The big mistake this couple made was signing papers without an attorney present.

"We all need to be aware because this happens during times of crisis," Forte said. "Or just happens everyday. This happened back in 1990."
