Mosley deemed mentally unfit to stand trial for Olbiston murder
UTICA, N.Y. (WKTV) - It is out of the criminal courtroom and into a psychiatric hospital for a murder defendant in the city of Utica.
An Oneida County Court Judge ruled Thursday that Dennis Mosley of Albany is an "incapacitated person," and incapable of assisting in his defense.
Mosley and co-defendant Kelly Marshall are accused of robbing Olbiston Apartments resident Allen Minor and stabbing him to death back in March.
Two psychologists testified Thursday that Mosley might be paranoid schizophrenic, and that he could not assist an attorney in his defense.
He's now committed to the custody of the State Commissioner of Mental Health for one year and will be periodically re-evaluated.
"If and when this defendant is found competent to proceed and is returned to Oneida County Court, we will proceed with our evidence at that time," said Prosecutor Michael Coluzza.
The competence of Mosley's co-defendant, Kelly Marshall, was not called into question. The criminal case against her is progressing, with hearings due next month.
