Trio charged after attempted theft from Wal-Mart, foot chase in Herkimer
HERKIMER, N.Y. (WKTV) - Three people are facing charges after police say they attempted to steal a cart full of merchandise from the Wal-Mart in Herkimer, and police say one of those suspects struck officers as they tried to take him into custody.
According to Herkimer Police, officers were called to Wal-Mart around 8 p.m. on Saturday, April 7, for a report of three people pushing a cart full of merchandise out of the store without paying for it.
When the officers arrived on the scene, police said the trio of suspect fled the scene on foot, with police pursuing.
Police said one of the suspects, Jose Rosado, 19, of Westmoreland, was caught in the Aubuchon parking lot on West Albany Street and began striking officers as they attempted to place him into custody.
He has been charged with two counts of resisting arrest, one count petit larceny and one count of second-degree harassment.
Police said Joshua J. Capirci, 19, of Frankfort, arrived at the Herkimer Police Station to check on the status of Rosado and was recognized as one of the original trio and was identified by Wal-Mart Asset Protection employee.
He was arrested and charged with petit larceny and unlawful possession of marijuana.
Andrea D. Vandyke, 20, of Delanson, the third and final part of the trio, turned herself in to officers at the Herkimer Police Department. She was also identified by Wal-Mart Asset Protection. She was charged with petit larceny.
All three defendants were arraigned in Village of Herkimer Court. Rosado was sent to the Herkimer County Jail in lieu of $2,500 cash and $7,500 bail bond.
Capirci was sent to the Herkimer County Jail on $1,500 cash and $4,500 bail.
Vandyke was released in court on her own recognizance and is set to re-appear in court on April 17, 2012
