The Federal Court of Appeals released Tuesday that it has upheld the conviction of Toussaint Davis, Marion Pegese and Robert Ward in the 2006 death of New Hartford Police Officer Joseph Corr.
Pegese has been the most vocal in saying he had nothing to do with the jewelry store robbery and subsequent death.
The trio had argued that their case should be re-tried due to "legal errors."
Officer Corr was killed as he pursued the three, along with a fourth man named Walter Richardson, following a jewelry store robbery on February 26, 2006 at Lennon's W.B. Wilcox in New Hartford.
Richardson was killed during a shootout with law enforcement in Pennsylvania.
