Police: Armed robbery of Subway in May was 'inside job,' three charged

NEW HARTFORD, N.Y. (WKTV) - Three men have been charged following a six-month investigation into an armed robbery of a Subway in May, one of them an employee who police say helped plan the heist.

According to New Hartford Police, an employee at the Subway on Commercial Drive, Kevin Cole, 31, of Utica reported that on May 19 around 10 p.m., a male had entered the restaurant wearing a mask, displayed a handgun and demanded money.

Cole reported to police that the male fled out the back of the store with cash from the register.

Police say they later determined that Cole had assisted in the planning of the robbery which was carried out with the assistance of Abege D. Berkley, 27 of New York Mills and Ricky C. Cummings, 39 of Utica.

All three have since been arrested and charged with petit larceny.

Cole was additionally charged with falsifying business records and falsely reporting an incident and giving a false written statement.

All three were arraigned in the Town of New Hartford Court.
