Man accused of firing gun, damaging windshield during argument

MARCY, N.Y. (WKTV) - A Utica man has been charged after authorities say he fired a gun, damaging a vehicle windshield, during an argument with a former girlfriend.

According to New York State Police, Robert F. Adesak, 43, of Utica, was charged with second-degree criminal possession of a weapon, third-degree criminal mischief, second-degree reckless endangerment, DWI and various Vehicle and Traffic infractions.

Authorities said that on July 28, 2012, at approximately 1:30 a.m., troopers responded to a report of "shots fired" on Linda Drive in Marcy. Upon arriving at the residence, the Troopers immediately noticed that a vehicle located in the driveway had a broken rear windshield. Further examination of the vehicle revealed a definitive bullet hole through the front windshield, authorities said, adding that an interview of the female complainant revealed that she had been having difficulty with her former boyfriend, Robert Adesak.

Adesak was stopped by Troopers a short distance from the residence, and as they approached the vehicle, investigators say they observed what appeared to be a handgun on the passenger side rear floor. Investigators conducted an inventory of the vehicle and located a "COLT Commander" semi-automatic pistol, a spent 30-30 rifle casing, and a wig.

Adesak was arraigned in the Town of Marcy Court and was remanded to Oneida County Jail in lieu of $30,000 cash or secure bond. A "Stay Away" order was also issued by the Judge and served on the Defendant at that time.
