Man convicted of killing woman in 2000 accident facing third DWI

A Sauquoit man, convicted of running over a woman and killing her 13 years ago is now facing his third DWI charge.

Scott Zimmer was arrested on March 17 when New Hartford Police stopped him on Route 8 for failing to stay in his lane.

According to police, his blood alcohol content was .20 at the time.

His case has been turned over to the Oneida County District Attorney's Office.

In 2000, Zimmer was convicted of leaving the scene of a fatal accident and it was never determined if he was drunk at the time he struck Joan Foley, because he fled the state.

Zimmer was sentenced to four months of weekends in jail, but was later sentenced to prison time for violating his probation.

In 2003 and 2004, Zimmer was charged with DWI.

The 2003 charges were dismissed as part of his plea in 2004 and he was sentenced one to three years in prison.

Archives indicate Zimmer was also arrested in 2007, found sleeping in his car. He refused a breath test and nothing ever came of this.

According to the District Attorney's Office, Zimmer's most recent case should be presented to a grand jury in the next month.
