Teen pleads guilty to taking part in assault on Officer

UTICA - Hector McClain faced seven charges in the assault this summer of Utica police officer Dzenan Sabanovic. There will be no trial for McClain - Friday,a plea agreement sent the teen to prison for four years.

This was a very unexpected turn of events; witnesses were in court today ready to testify for a hearing to determine whether police made any suggestions while showing witnesses a photo array with defendant Hector McClain's picture in it.

But right before the hearing was to take place, McClain and his attorney watched the video of the actual assault on Officer Sabanovic, and McClain chose to plead guilty today.

Instead of facing the seven crimes at trial - the most serious of which could have meant a 7-year prison sentence, the teen plead guilty to the top count of assault in the 2nd degree in exchange for a four year prison sentence.

Before the judge accepted the plea, the district attorney had lengthy talks with Officer Sabanovic, who said he was satisfied with the sentence and plea.

"He's young. He still has a chance to turn his life around," Officer Sabanovic said. "I don't want him to put anyone else through what I had to go through and I obviously don't want him to fail in his life I want him to move on and learn his lesson from this, and hopefully get a better life ahead of him."

Several members of Hector McClain's family were in court today, visibly upset - bursting into tears and having to leave the courtroom.

You're absolutely right!Corrections isn't suppose to rehabilitate.Although I can say is Corrections does keep this individual away from the PUBLIC for four years. I'm sure the PUBLIC does'nt mind that.I feel safer now!

here we go again another life lost in the effortless and ineffective corrections system when will they learn that incarceration is not always best in efforts to turn someones life around not saying that he might not come out with a new look on life but what if he comes out with a chip on his shoulder then what send him back so he come out and do the same thing you want rehabilatation make him pay through the community doing something positive do something he might be good thats saving someone :/

Thank you Tito! You hit the nail on the head. Ya know..I read FIGHT THE POWERS reply over and over and it still baffles me how he got through life. Not one single sentence made sense. Must be getting an education was something that he did not agree with either. So sad. Wonder how he was able to operate a computer.

young person will be spending a considerable amount of time in jail. I am sure this probably isn't the right environment for him to reform. However, where do we draw the line of this type of action? Obviously he has no respect for the law. What would happen if he just got a slap on the wrist and sent home?? Would he feel he could do it again with no consequences? There has to be punishment. Not only to teach this kid what he did was wrong...but to show others that it will not be tolerated.

The act was wrong, illegal, and by all means punishable. The problem is that the officer's hopes of the young man turning his life around are bleak, given our current system of "Corrections", which truly wharehouses, not CORRECTS anything.
