"Flaco" trial postponed one week

UTICA - Wesley Molina-Cirino, also known by his street name of "Flaco," was supposed to stand trial in two weeks for the murder last year of Utica Police Officer Thomas Lindsey.

Molina-Cirino is accused of shooting Officer Lindsey while the officer was in the middle of a traffic stop on April 12 of last year.

They were supposed to start picking the jury for Molina-Cirino's murder trial two weeks from yesterday. Actual testimony would have begun two weeks from today.

But the trial's been pushed back from March 3 to March 10. Judge Barry Donalty's assistant says the judge wanted the prosecution to have more time to have Molina-Cirino's statements to police - hours of statements -transcribed.

Molina-Cirino's attorney says the delay was mutual-she's glad to have more time to pore over all the material in the case.

"I am okay with it," said Rebecca Wittman, defense attorney for Molina-Cirino. "It was kind of a mutual decision between myself and the D.A. Obviously, the judge decides, but we all thought it might be for the best, because we were going to be cutting it very close, getting the transcripts and the tape with kind of the subtitles."

For this trial, the prosecution plans to try out, for the first time ever in Oneida County Court, a new way of translating, where the jury would see the videotaped questioning of the defendant by police and see subtitles at the bottom of the screen.

You should rot for that statement! Hoe dare you say that man is innocent. OKay good try. I find it very hard to believe that he has lived in Utica this long and doesn't speak english. Thats a good excuse!

The death penalty isn't going to solve anything. However, if found guilty let him rot. I personally would feel just as guilty with the dealth penalty. what happened was wrong, but who are we to judge someone to the death penalty. Just my opinion.
