Stanistreet takes plea offer in Cueball Beating

UTICA - The trial has ended for one of the men accused of beating another man to death at a party last August.

Bradley Stanistreet took a plea deal this morning, and could be spending up to 10 years in prison for his role in Carl Hill's death. Stanistreet could now face up to 10 years in state prison after pleading guilty this morning to gang assault.

He also faced a charge of manslaughter, which has been dropped. And today he told the judge his version of what happened.

After almost a week of testimony, Brad Stanistreet decided to end his trial by taking a plea deal. Discussions of him pleading guilty have been going on all week something not ordinarily done during a trial.

"Ordinarily if you get to the point where you're drawing a jury and you've drawn the jury and you've started, the trial goes ahead and finishes," said Timothy Fitzgerald, assistant district attorney. "So I would have to say this is unusual. "

Speaking before the judge, Stanistreet gave his account of what happened during that party. He continued to deny using the pool ball during the scuffle.

"The pool ball was in my back pocket and when I pulled it out, the pool ball ripped through the hole ripped a hole in the sock," said Bradley Stanistreet. "I never used the pool ball on Carl Hill."

Stanistreet's lawyer - Les Lewis - says he had long discussions both with his client and his family. He says even if Stanistreet didn't use the pool ball, he still provided it to Cory Adam to use, who already plead guilty to manslaughter in this case.

Stanistreet would then have been considered an accomplice.

"If he was convicted, his exposure would have been in excess of whatever Cory Adam got," Lewis said. "Cory Adam got 15 years. I can not speak for the judge, but I can say his sent would have been in excess of 15 years perhaps 20 years."

At the end of his guilty plea, Stanistreet walked by his co-defendant, Kevin Stolarcyk, and told him to quote "Good luck, kid."

Stolarcyk is still on trial in the beating death of Carl Hill.

You are correct there is no punishment bad enough for taking an innocent life. However you can not say Carl Hill was innocent, he was intoxicated, he was at party he was not invited to, and he was hitting people with a weapon. When you talk about innocent, every witness testified the Kevin was not doing anything when Carl hit him. Doesn't that make him an innocent victim??? These kids made a bad decision but please don't try and say that Carl Hill is an innocent victim, He wasn't!!!!

you claim to know Kevin, and if you were in court then you would know that Kevin didn't kill Carl the pool ball did. If that is the definition of gangs in the New York Penal Code we are all in trouble. This means that any of use can get in trouble if there is more than one of us and a crime is committed. In addition why were the kids who attacked the police officer in Utica not charged with gang assault, there were 3 of them on 1 officer. That would constitute a gang. You may not view this as a gang action, but according to the New York State Penal Law, this was a gang activity. This is a tragedy all the way around. It seems that especially 15 - 25 year olds don't consider the consequences of their actions before they take them, especially when there's alcohol/drugs involved. Everyone that was present while this assault was going on is culpable in some way. Hopefully this incident and the resulting repercussions will serve as a lesson to SOMEONE.

If you believe the testimony provided by the Cory, John and Brad along with others at the party. There was one kid who threw the first punch, and it wasn't any of these kids or Carl. This same kid is accused of punching and kicking Carl on many different occassions. The beating this person is accused of giving Carl is worst than any beating Kevin or John are accused of giving Carl. This is by the testimony of most of the witnesses. After a week of testimony, I am still left with one question:Why were these kids the only ones charged? As for the outcome of this it could easily have been Kevin who was dead by the actions of Carl Hill that night. This was not a gang event, this was a group of high school kids getting together for a party and a fight broke out. There was not organization in these groups. The fact that 2 of these individuals have plead guilty to gang assault is just the counties way of proving a point. These boys are did not hit this kid in a group it was all individual and although this does constitute assualt is does not constitute a gang.

In actuality it has nothing to do with the truth. Bottom line 2 groups of people made bad choices and unfortunately someone lost their life because of it. Hopefully those who are alive today and had involvement realized their mistakes and learn from them. As for Hills friends and family this is probably a hard time for them, nothing can bring him back or make the situation better, but throwing away someones life by putting them behind bars may not always be the answer.
