Sammy Rivera takes stand in "Flaco" trial

UTICA - Sammy Manuel Rivera, the man who was driving the car Officer Lindsey pulled over, took the stand Thursday and positively identified the shooter as Wesley Molina Cirino. He turned out to be on the witness stand for about three and half hours. He outlined the events of his night on April 12th from early evening where he bought and sold drugs, to the moment he heard gun shots and saw Lindsey fall to the ground.

Rivera says that night he was all around the Cornhill area between houses and stores buying and selling drugs. He says he then headed down Nielson Street rolling through an intersection. This is the point in the story when Officer Lindsey pulled him over. He says during the stop he noticed Wesley Molina-Cirino around the corner sitting in a black Monte Carlo.

Rivera says Lindsey did what he had to do in the police car and then approached his red Neon. Rivera says he then saw Officer Lindsey flinch, there were several gun shots and Lindsey was down. Rivera says he then looked up right into the eyes of the shooter.
