Stolarcyk sentenced on assault charges in Cueball Beating death

UTICA - Kevin Stolarcyk, the first of four men charged in the beating death of a Rome man last Summer, was sentenced in Oneida County Court Friday.

A jury originally found Stolarcyk not-guilty of manslaughter charges and were deadlocked on a gang assault charge. Stolarcyk then agreed to a plea of misdemeanor assault. For that, Judge Michael Dwyer sentenced him to one year in prison. With time served he will be out of jail next week.

"I wish Carl was home; I wish he was with us," said Jessica Hernandez, Hill's girlfriend. "I wish he wasn't where he is now."

Many lives were shattered - changed forever the night of August 12, when rivalry between young men from Westmoreland and Rome spun out of control, taking the life of 20-year old Carl Hill.

And for at least one of those left behind - the girlfriend and mother of Carl Hill's children - making sense out of all of this is not an easy thing.

"There is no reason for my children to be without their father," she said.

Hernandez did not give an impact statement; no need really, as Stolarcyk's sentence stemmed from a plea deal. But there is something she would have liked to say.

"I would let him know how much he took from us," she said. "How much he took from our children and what he did was wrong."

In a brief statement, Stolarcyk apologized to the court and his mother...but absent from his apology was Hernandez, now living without her long-time partner. But she says any remorse, any apology is simply too late.

"Now they want to regret and go home and be with their family, that is never going to happen for Carl," she said.

But both Stolarcyk and Hernandez agreed on this main point:

"Everybody had a choice at that party," Stolarcyk said. "And nobody made the right decisions."

"If they just said "Stop. Wait. This is wrong," one of them would have stepped up and said anything he still would have been alive right now," Hernandez said.

Now three men - Brad Stanistreet, Cory Adam and John Almanza, are awaiting their sentences, which are expected to be much more severe than the one year that Kevin Stolarcyk received.

This was a horrific situation all around. There are no winners in this case, what's done is done.Those of you that are getting wrapped up in analyzing this case down every little detail are totally missing the point. For example:Yes he kicked him but he didn't "hit" him..does it really make a difference? A young man is dead for no reason. And to those swearing revenge on the people who committed the crime isn't going to solve anything either.Lets stop this vicious cycle before others get hurt!

Don't let them get to you. It's sad how people let their emotions cloud their judgement and block them from seeing the truth. Bottom line, You and I know Kevin did not kill Carl, Oh!and so does the judge and jury..but I guess we're all wrong. Fights and drunken party's at Camelot Village are common. I know people that live there and this type of thing (minus a death) is common. Carl has been in fights there with others before. Mind you this is a Tariler-Mobile Park. Look at Sheriff's log and see how many times problems have occured there. The girl was at least right in saying why didn't someone stop it.

Please get your facts straight. Kevin kicked Carl and that is it. He never hit him. I agree he should have said something to Carl's family. He was not however responsible for Carl's death. Carl caused more damage to Kevin than Kevin did to him. The person that caused the injuries that killed Carl was Cory Adam and he is the one who should apologize for that action.

Hernandez is still pointing the guilty finger at the wrong person. Stolarcyk had nothing to do with Hill's death. The DA was even quoted as much in the Rome Sentinel. Of course, where is her apology to Stolarcyk for her boyfriend hitting him in the back of the head like a sucker punch? She forgets the fact that Hill, while a victim, was not an INNOCENT victim.

That being said, Kevin's actions did not kill Carl Hill, Correct me if I'm wrong, but didn't the pathologist who actually conducted the autopsy testify that the COD was a blunt injury to the head? Didn't it come out in the tial that Kevin had no part of that? And wasn't he was busy nursing his own wounds (caused by carl) when the severe beating took place?
