Case of student accused of recording female performing sex act in Proctor bathroom adjourned until May

UTICA - The case against the Proctor High School student accused of recording a female student performing a sexual act on a male juvenile has been adjourned until May 23.

"My client walked into the men's room at Proctor High School, and he saw something of a sexual nature going on," said Les Lewis, Ruffin's lawyer. "As young kids do with cell phones, when he saw it, he just took his cell phone out and took a picture of it."

Investigators say Sirdell Ruffin made the recording the men's bathroom during school hours back in November. Ruffin's lawyer doesn't deny his client's role in the incident, but he says the felony charge against him is unwarranted.

"I'm not saying that what he did should be commended," Lewis said. "But he probably did something that many, many teenagers would do because of carrying their trusty cell phones around. And he saw something that he thought was kind of interesting."

Sirdell Ruffin is currently out on bail.
