Case of student accused of recording female performing sex act in Proctor bathroom adjourned until May

UTICA - The case against the Proctor High School student accused of recording a female student performing a sexual act on a male juvenile has been adjourned until May 23.

"My client walked into the men's room at Proctor High School, and he saw something of a sexual nature going on," said Les Lewis, Ruffin's lawyer. "As young kids do with cell phones, when he saw it, he just took his cell phone out and took a picture of it."

Investigators say Sirdell Ruffin made the recording the men's bathroom during school hours back in November. Ruffin's lawyer doesn't deny his client's role in the incident, but he says the felony charge against him is unwarranted.

"I'm not saying that what he did should be commended," Lewis said. "But he probably did something that many, many teenagers would do because of carrying their trusty cell phones around. And he saw something that he thought was kind of interesting."

Sirdell Ruffin is currently out on bail.

If it was documented, the girl was underaged, the pics would be "child porn" in the eyes of the law, wouldn't they? I would assume that a kid that is 19 and still in highschool is not the brightest bulb on the christmas tree anyway. I bet he is about to get a "legal" education, courtesy of the courts. No charge to him.

Cell phones should be banned in schools. We all got through high school without them; these students don't need them. They tape fights on cells and put them on youtube. Google. They send around provocative photos, which get into the wrong hands. Equally as bad, parents text their children DURING school hours. Really, what good are cells in schools anyway?

This is crazy - our kids are really going downhill fast nowadays.....maybe we should re-think this whole "NO SPANKING OR PUNISHING KIDS" thing - beause there is NO RESPECT or ANY TYPE OF "GOOD JUSDGEMENT" calls made from any age children these days. If they arent videotaping gang-fights, they are plotting (at early ages) to hurt/possibly kill their teachers.....Obviously, they choose violence to handle situations, even tough they are growing up under the "NO SPANKING" ages.

Something he found interesting?? so he just took a pic to share with his friends later it should say. He is considered an adult, not some young teenager. He should of acted like the adult he is and alerted security or a teacher of the situation. Instead he committed a crime and needs to be punished. End of story.... instead of his lawyer acting like this is some innocent act that any kid would do
