Babysitter takes stand in his own Huntley Hearing

UTICA - A man accused of sexually assaulting a six-year-old girl he was babysitting took the stand during a hearing Wednesday in Oneida County Court.

It was an evidence suppression hearing where defense attorneys try to keep certain evidence from being admitted at trial.

In this case, it was a recorded, 'controlled' phone call during which Chicherchia allegedly admitted the abuse to the child's mother.

Chicherchia said he drank and smoked marijuana the day of the call and does not remember it. He also claims investigators pressured him into confessing.

Prosecutors today said Chicherchia's own signature proves otherwise.

"And he just kept saying it and saying that I did it, I did it and I did it, over and over again, and I didn't want to sign anything or say anything to them," Chicherchia said on the stand. "And I repeatedly said I don't want to say anything, you know, and he just kept pressuring me to talk."

"Do you see this section, statement of Miranda Rights?" asked prosecutor Doug DeMarche. "Yes," Chicherchia said. "Do you see five statements under there?" DeMarche asked.

"Yes," Chicherchia said. "Do you see initials after each one of those five statements?" DeMarche asked. "Yes," Chicherchia replied.

"Whose initials are they?" DeMarche asked.

"They're mine," Chicherchia answered.

"Who put them on there?" DeMarche asked. "I did," Chicherchia replied.

Oneida County Court Judge Michael Dwyer will rule at a later date on whether or not that recorded phone call can be used as evidence in Chicherchia's trial which is slated for June 16.

If convicted of predatory sexual assault, Chicherchia faces up to 25 years to life in prison.
