Pettersen rejects plea offer in Medicaid fraud case; trial to start this Summer

UTICA - Ole Pettersen is facing numerous counts of falsifying business records, among other charges, after allegedly cheating the State Health Department out of thousands of dollars in Medicaid benefits.

And Monday, he rejected a plea deal presented by the State Attorney General's office. What that means is that now Pettersen's case will be going to trial.

The only time Pettersen hesitated with an answer Monday is when Judge Michael Dwyer informed him that if he rejected the plea deal, he could spend up to 15 years in prison if found guilty. And even then, he still stood by his answer.

Pettersen is facing 16 criminal counts, including falsifying business records and offering a false instrument for filing. Pettersen is the former executive director of the Center for Addiction Recovery in Clinton.

The Attorney General's Office alleges that Pettersen filed false claims to Medicaid for services not actually provided in 2003 and 2004.

According to court documents, those claims include assessing and evaluating clients for the chemical dependency program, as well as medical treatments.

Right now, Pettersen's lawyer, Frank Policelli, was supposes to have looked through the Attorney General's evidence by Monday - but says he will require more time for this case.

"There's just been volumes and volumes of documents that need to be reviewed in connection with the indictment," Policelli said. "Some documents have been provided. I know Mr. Tortora told me there's other documents he has I can arrange to review."

In response, Ralph Tortora of the Attorney General's Office says all of the documents related to this case have been given to Policelli. Neither attorney would comment further on the case when asked.

The next time Pettersen is scheduled to be in court is June 9. That will be to make sure everyone is on the same page and the discovery of evidence is complete.

Judge Dwyer says he hopes to schedule the trial sometime in late June or early July.

To anon - NYS is not just targeting Ole. It is not "chem dependency clinics" persay, but Medicaid providers. Yes, others in our area are being targeted you just haven't heard about them yet. some have just begun the process. Others in NY who have been through the process and cleared of charges are suing NYS. Much of this was explained in the comments here in the last article. Links were given to the lawsuits and similar abuses by the federal govt. towards medicaid providers.

Methadone is not free. NYS withheld monies due CAR which NYS can do "without cause." Ole has not been found guilty, yet NYS can do this. Innocent till proven guilty? Not in NYS. CAR could not afford to dose for free. It is now costing Oneida County quite a lot more to dose these clients in Syracuse, than when the Meth clinic was right here. Shame on NYS - NYS has hurt the taxpayer, the clients, and increased crime all in one shot. NYS has robbed Ole. No way can he carry your friends.

NYS dropped those clients and told everyone CAR was closed when it was not. CAR kept going until a very short time ago - NYS pulled the clients that they could pull.

Disgruntled clients and disgruntled former employees are part of the pkg of such a business as this. There are many who were helped - clients kept on with no ins., employees given salary when not working. Neither the compaints nor the praises have anything to do with the charges. The charge is intentional medicaid fraud. Ole is innocent - nothing criminal was done to NYS - though NYS has acted criminal toward him.

He is going to jail and help the all the drug addicts there. He can run his church services in there too. A good way to pay back our tax dollars and still help drug addicts and help the inmates find "Ole's" God. It's a win-win situation for all, don't ya think?

What about holding him reliable for the "clients he serviced" who were just dropped with no warning? He has endangered their lives, these people relied on him to help them stay safe and healthy, he dropped the ball on them. I have had several friends relapse because there was no methadone maintenance available for them. He knew he was being investigated and knew he could be shut down, he did nothing for the clients he serviced, he left them on the door step with nothing.
