D.A.'s Office: January Vernon death was intentional

VERNON - New details emerge in the death of a Vernon man back in January.

Oneida County Assistant District Attorney Kurt Hameline tells NEWSChannel 2 that suicide has been ruled out.

Joseph Giacona Jr. was intentionally killed at his home on Sconodoa Street. He was found, by his 13-year-old son, shot in the head, and later died in the hospital.

The investigation into his death is complete and lab results are in. Right now, the D.A.'s office is conducting a final review and beginning to build a case.

Hameline doesn't expect anyone to admit to this crime.

"I will tell you this - police are not going to make an arrest," Hameline said. "The investigation as it stands right now will be submitted to a grand jury for its review."

Hameline hopes to be in court to present the evidence within the next month. He says the person responsible for the homicide will be charged with second-degree murder.

The Oneida County District Attorney's office is no longer in touch with the victims family, but says they are in contact with his fiance.
