Courtroom heats up in Ole Pettersen / Medicaid Fraud case

UTICA - Tensions mount in the Oneida County Courtroom over whether a judge should recuse himself from a case.

The case at question is the one of Ole Pettersen - the former director for the Center for Addiction and Recovery. He's accused of bilking Medicaid out of half a million dollars.

On Thursday, his attorney expected Judge Michael Dwyer to recuse himself due to what he's calling a "conflict of interest."

But that didn't happen.

Frank Pollicelli - who is representing Pettersen - wants Judge Dwyer to recuse himself from the case. The reason being that Dwyer's Clerk Carl Del Buono - was Chairman of the Board of Directors for Insight House around the time of the alleged crime.

Policelli explained in court that a harsh letter-writing campaign started after a contract was supposedly awarded to the Center for Addiction and Recovery (CAR) over Insight House in Herkimer County in 2003.

Policelli says in the letter that it appears that Insight House became upset with the loss and started to what he says complain about the contract and blast CAR.

He says words were also exchanged on CAR's end as well.

His reasoning for the recusal is not based on the integrity of the court or the judge. He says it's to uphold an appearance of being unbiased.

"It may come out during the course of the trial that the motive of prosecution is based on the Administration Agency Oasis is trying to find something bad to say about CAR - perhaps motivated through insight house," Policelli said.

And after all that, Judge Dwyer did not make a decision on whether to recuse himself. He then set a trial date for Monday, October 6.

Policelli then became upset that the judge was making decisions and setting dates without even deciding on whether he'll be presiding over the trial.

Dwyer says he'll make his decision soon but gave no timeline.

So for now, the trial date is set, much to the disappointment of Pollicelli and his client, Mr. Pettersen.

Um, I think that "disgruntled competition" is being shown in court to be true by documentation. THAT is what needs to be owned up to by those who have done this to CAR. The last commentor seems to be privy to the details if they want CAR to own up to their actions. Or is the commentor just disgruntled and HOPES a crime has been committed. I doubt it, since none has. I think they will be disappointed as this progresses in court.

I see things have progressed from "disgruntled" employee to "disgruntled" competition. I would have thought after all these months, at least some responsibilty would be taken for their own actions, but it looks like it is just the same old, same old. I guess the Pettersen's, and I am assuming that other piece of garbage that worked there, still hasn't learned. That is just a shame.

Let's revisit this statement: "He's accused of bilking Medicaid out of half a million dollars." Ole didn't bilk anybody out of anything. He had a business, and a staff to pay along with heating and electricity etc. All monies were earned, and went to pay bills. The state is squabbling over paperwork, and it took them 2 years to attempt to set CAR up. With Insight House's connections, which have only begun to be revealed, the whole investigation is tainted.

If there is a conflict of interest, of course the Judge needs to step down. Can Ole get a fair trial in this area? It appears that he is going against an entire local system which spreads into a state system of favoritism, corruption, and bureaucratic BS. Medicaid freud - you want freud - just look around at the ppl who receive benefits, the gold they wear, the name brand sneakers, the cars they drive; even if Ole did make some mistakes, he still provided a desperately needed service.

The judge has been given very good reasons to recuse himself, and has no good reason NOT to. If he does not choose to recuse, it will speak VERY LOUDLY about how thick the corruption is. His not deciding to recuse himself immediately speaks loudly enough.

OOP's Wipe your face Judge, you've got pie all over it. This whole scenario is sick. Ole is innoceent, he has helped many and his business expanded repidly because of his concern and honesty. People always seem to go with the absolute worst they hear about someone else, usually because it makes them feel better about themselves. This whole community needs to wake up and stand beside, behind and for what is right. Threats and accusaions are the tools of a corrupt NYS bureauracy called OASAS.

It would seem that a bias towards the prosecution is evident here, but we have to question ourselves...Why? What does this man stand to gain from having a bias against Ole? From my experience, OASIS has always been run poorly, not by the workers, but by the management...and if that isnt enough, Insight House is worse, Im sorry that there is a business that STANDS for something, and can be honest. Kudos to you Mr.Pettersen; Stand Firm, Stand Strong, Never Give Up, and Never Surrender

CAR - because they are for profit - received NO MONEY when they helped the poor, whereas Insight House received money each time. Nonetheless, despite the law clerks insinuation that CAR was not helping the poor, they were - for nothing - and that is documented. CAR was not fighting offensively, but stating the truth when lies came up against them.

As an observer in court today, the judge's bias is already showing. Why does he want to stick this trial in a slot that gives his defense no time? Why the rush? Pros. has had 2 years, defense 4 mo. Why not recuse? Because his residing is important for the corruption that reigns in Oneida County. They are all connected. Otherwise, recusal is a no brainer. The law clerk wrote to NYS negatively concerning CAR. Can you say involved? Good day in court today. True colors showing through.
