Common Councilors: why the curfew law was voted down

UTICA - Utica's Common Council rejects a bill that would allow for a curfew in the city. The proposal was put forth by West Utica Representative Jim Zecca. However, after an executive session, then a vote of 7 to 2, the proposed law was rejected. Zecca says problems on the street will not go away, and something still needs to be done.

One of the council members we talked with, who voted against this ordinance Wednesday night says that he and his colleagues understand there is a problem that needs to be addressed, however they say this is not the way to do it for two reasons. Number one a lack of police presence and number two, there is actually a legality problem that comes with it.

The proposed curfew law would have been restricted to West Utica and called for kids ages 15 and under to be off city streets between the hours of 10 pm and 6 am.

Councilor at large Frank Meola says before the council voted Wednesday night, they were advised by their attorneys that the restriction of the curfew law, to one part of the city, would be borderline unconstitutional.

Meola says the majority of the councilors took that information, and combined it with the fact the city does not have a full police department, and decided to vote "no." The compliment for UPD is temporarily down 17 officers for various reasons. Meola says he and other councilors would rather wait until the compliment is back to full strength before acting on a law that has some questions.

"We're hoping as soon as we rebound from the loss of patrolmen out there, that we will be able to get to those issues in West Utica and other parts in the City of Utica," says Meola.
    
Councilman Jim Zecca, who proposed this ordinance says if the council members are going to vote it down, he wants them to start acting now on other solutions because he says there are a lot of issue that need to be addressed in his district.

I think that ALL OF utica needs to have a curfew. Hell i grew up in a town with a cerfew and there was 0 problems there! children need rules and if the parrents WONT do it then the LAW ENFORCEMENT mine as well. thats what they are there for. maybe if 16 and younger were off the streets all over utica after 10 pm then theyd get up for school, or do some chores, less drug deals and less violence. who would seriously oppose this ??? do you have a problem with your kid being home?

this curfew should be for the whole city!!...even here in north utica there are problems us TAXPAYERS need solved, we had to be in by dark back in the day!!!...thats why we turned out good, not like these punks roaming the streets, the parents dont care one bit where their kids is, but when he gets shot you see them crying on the news that he was a good kid, but WHY was he on the streets at 2 AM?....get them off the streets NOW!!!!

A curfew only in W. Utica is not going to change kids staying out late. They will just cross the imaginary line to freedom (assumming that would be Genesee St)...I love the fact that it's just the parents fault and there are only bad parents. It's a community problem, but nobody does anything about it, expecting the next person to do it. When you point your one finger out at someone, there are 3 fingers pointing back at you. Take your place in the community and stop complaining

It is so sad that we have to be looking at curfews, but hopefully once the police have their numbers back up, this is something that can be looked at again. Its something we need to seriously consider, because let's face it, Utica is not what it used to be. Not everyone here is part of the criminal element, but there is far too much of that here now, and I find that I am considering leaving because of it. The only thing keeping some good people here is that they lack the funds to get out.

Nothing will ever change , just alot of talk! Alot of parents have no desire to be PARENTS!. Just because one can reproduce doesnt make them a parent! We give out welfare,food stamps,free school meals for what! Utica is on it's way out,it will just become more of a hell-hole and a place for imigrants to live(with their tax breaks) It is sad, this once was a nice city to live in!

They should have passed that law and made it for the whole city. I live outside Utica and have decided to never move back upon seeing how much the city has gone downhill. My children will never attend my alma mater (Utica Senior Academy). I used to drive bus for Utica kids and they helped my decision to not send my kids there. The majority of the kids have no respect for authority. And CPS does nothing to the bad parents, they go after easy targets like working families who are doing there best

Kids are easily influenced. If young kids are on the streets with the older kids, there is potential there for wrong doing. It would be a start to seprate them. No it wouldn't be a final answer to the criminal and menacing activities, but it would be proactive! Why are parents allowing their children to roam around at night...society has changed and is no longer safe. When did parents stop parenting? A curfew never hurt anyone.

not all West utica residents fall under that stereotype. Not all drink & drug. There are many that do, but it's not onloy in West Utica, I have seen it in South Utica as well, it's just not made public, that's all. There should be a curfew, no one needs to be on the streets at night anyway, especially children!

Sounds to me like a cop out from a bunch of spinless Council Members too afraid to take a stand to clean up our City. IMO - they ALL should be voted out at our next Election and replaced with men & women who are not afraid to stand up for what is right. I wonder how many of these Council Members live in the areas of where kids are roaming the streets after 10 PM!
