UPDATE: Conflict of interest causes judge recuses himself from fatal accident case

STEUBEN, N.Y. (WKTV) - Brandon Razzano, the man accused of driving drunk following a fatal accident was back in court Tuesday night. The accident took the life of a Boonville woman.

Razzano was in the Town of Steuben court for a hearing Tuesday night. However, Judge Roger Maclaughlin recused himself from the trial because he knows both families involved.

The attorney representing Razzano, Les Lewis, says the case will now get reassigned to another judge in another town or village.

"He (Maclaughlin) sent all the papers down to county court", said Lewis. "Apparently Judge Dwyer is going to re-assign another justice of the peace to take Judge Maclaughlin's place."

Lewis says no date has been set for that future proceeding.

Razzano has been charged with DWI, for his role in the accident that killed Laura Gribneau of Boonville.

I wonder how many of these one man judge/jury/executioners will be willing to apologize to Mr Razzano when DWI charges are dropped. If any of the local media are worth a nickel they'll be following tonight's court session where BAC results show he was NOT legally drunk or impaired. For their sake, they had better hope Mr Razzano doesn't hold a grudge, he's got the most rock solid case of slander in a hundred years. Shame on all of you crucifying him based on what you see in the news, shame!

IF Brandon was driving while intoxicated, that is wrong....it does not however make him RESPONSIBLE for the accident. He MAY have contributed to the accident....but he did not make that driver pull out in front of him. From what I am reading, there is PLENTY of blame to go around.. WKTV should have mentioned that Brandon had the right of way. Let's give Brandon the benefit of the doubt (innocent until PROVEN guilty!) If it was YOU or a member of your family you would want the same courtesy.

I prefer to hear and see both sides of a story. I've read and seen enough of one driver. Post the photo of the driver who failed to yield. The one who pulled out into the intersection. There is anger, pain, and suffering with all families involved. Let's give everyone the entire story. We only hear and see what the media WANTS to show us.

Has Mr Razzano been assigned protection? That mother has already tried to burn down a building. Is her grief so severe that she may try to hurt him, or his residence or who knows what else. I would be worried. I'd get Mr Lewis to ask for a restraining order.

The OD is very fond of playing loose with the truth. I wish they would report the facts in this case. The fact is the car with the fatalities had a stop sign and should have yielded the right of way to Mr. Razzano. They are technically at fault for this accident. If Mr. Razzano was drinking and driving he should be brought to justice for that charge, not have this innuendo that he caused it. That said, this is a very sad situation. Many lives have been and will continue to be harmed by it.
