UPDATE: Conflict of interest causes judge recuses himself from fatal accident case
STEUBEN, N.Y. (WKTV) - Brandon Razzano, the man accused of driving drunk following a fatal accident was back in court Tuesday night. The accident took the life of a Boonville woman. Multimedia Razzano was in the Town of Steuben court for a hearing Tuesday night. However, Judge Roger Maclaughlin recused himself from the trial because he knows both families involved. The attorney representing Razzano, Les Lewis, says the case will now get reassigned to another judge in another town or village. "He (Maclaughlin) sent all the papers down to county court", said Lewis. "Apparently Judge Dwyer is going to re-assign another justice of the peace to take Judge Maclaughlin's place." Lewis says no date has been set for that future proceeding. Razzano has been charged with DWI, for his role in the accident that killed Laura Gribneau of Boonville. The fact is the car with the fatalities had a stop sign and should have yielded the right of way to Mr. Razzano. They are technically at fault for this accident. If Mr. Razzano was drinking and driving he should be brought to justice for that charge, not have this innuendo that he caused it. That said, this is a very sad situation.
