Oneida County judge recuses himself from medicaid fraud case

WKTV News

UTICA, N.Y. (WKTV) - An Oneida County judge has decided to recuse himself from a medicaid fraud case.

Judge Michael Dwyer is handing over the case of Ole Pettersen to judge Barry Donalty. Defense lawyer Frank Policelli wanted Dwyer to recuse himself, citing "appearance of partiality."

Policelli says his client had a rough business relationship with one of Dwyer's law clerks.

Pettersen is charged with bilking medicaid out of hundreds of thousands of dollars while he was director of the "center for addiction recovery."
