Killer in 1982 murder trial now free on parole

By JOLEEN FERRIS

UTICA, N.Y. (WKTV) - A high- profile killer from the days when Central New York was plagued by organized crime, is free after 26 years in prison.

It was the early 1980s. The body count grew as organized crime dominated local headlines almost daily in Utica and surrounding areas. One of the victims was a 23 year-old woman named Dawn Grillo.

Three men went to prison for her murder. One is now free on parole.

On February 20, 1980, a cadaver dog had to be lowered by rope into a steep ravine off Wilson Road in Frankfort where he found Grillo's body buried beneath ice and snow.

Oneida County Court Judge Barry Donalty - then a member of the State Attorney General's Organized Crime Task Force - went to grand jury and got an indictment against three men: Anthony John D'Amico, Dominic Bretti and Donato Nappi, forcing the trio to stand trial for Grillo's murder.

Supreme Court Judge Michael Daley was a prosecutor in 1982; he tried the case, winning a murder conviction against all three.

It's been 26 years, but his memory of the case still remains clear.

"It was a very difficult trial," Judge Daley said. "It literally could have gone either way. But luckily the jury accepted the prosecution's theory of what occurred as opposed to the defense theory."

Of the three men convicted of Grillo's murder, one died in prison, and one is still behind bars. But a third - Donato Nappi - was recently released from prison. The man who prosecuted Nappi nearly 30 years ago hopes the parole board decision will not prove to be a bad one.

"Well, my hope is that he stays as a law-abiding citizen," Daley said. "He's probably in his mid to late 60s at this point."

Donato Nappi is free, but with conditions - he must find a job or enter a vocational program, abide by a curfew, submit to drug testing and cannot associate with certain individuals.

The parole board will not say where in Central New York he is living.

It was all articles in the Utica newspaper. I imagine you could go to the newspaper and look in their old papers. Wish I could remember his name. I'll write a separate comment to the paper.

I remember a writer for the Utica Observer who wrote about all the heinous crimes in Utica. I believe at one time he was very ill. Anyway I still think about the young lawyer who was shot in his bosses law office. Why didn't they ever catch who did that? I believe his name was Joey Duquino. I was horrified as I read all his stories. I believe the writer called the murders deer slayers or those were the words he used. Great writer, he told it like it was. You have different thugs now in Utic
