VERNON, N.Y. (WKTV) - State Police in Oneida announce that they have made an arrest in the homicide of Joseph Giacona, which occurred in January 2008, in the Village of Vernon.

Police are not releasing the name of the individual arrested until a press conference at 2 p.m. on Thursday. However, the Oneida County District Attorney's Office says that it is Joseph Giacona III - the 13 year old son of the victim - who has been indicted in the case.

At approximately 3:14 p.m. on January 24, Oneida County 911 received a call from a 13-year old boy who stated that he had arrived home from school and found his father, Giacona Jr., lying on the living room couch with a head injury.

Vernon Fire Department and ambulance personnel responded to the scene and transported Giacona to St. Elizabeth Medical Center in Utica, where he was pronounced deceased.

The case has been adjourned until October 3rd, Oneida county District Attorney Scott McNamara said. McNamara also said that Giacona III is being held without bail, but because he is underage, there is no word on where he will be held.
