Omar Thompson cleared in Oneida Street shooting

UTICA, N.Y. (WKTV) - He told police and prosecutors they had the wrong guy, and it turns out, they did. Omar Thompson was under arrest for the murder of Mark Dukette of Camden, and for shooting a second victim who survived.

The Oneida County District Attorney now says that Thompson had nothing to do with the crime.

The woman who survived that shooting on Oneida Street in early March was adamant when she picked Omar Thompson out of a photo array. We saw her testify at a felony hearing and she said Omar Thompson was absolutely the man who shot her and killed her friend.

Last week when prosecutors went to put this case to a grand jury for a possible indictment, Jeannie O'Brien was not so sure. About that time, prosecutors got phone records they had requested and those lead to another man, Mark Anthony-Ware. New York City Police found him and investigators from Utica went to a Manhattan precinct to meet up with him. Now he is under arrest for Mark Dukette's murder. Oneida County's District Attorney says his investigators spent the past week doing something they do not normally do: clearing their original murder suspect.

"I'm just happy that we were able to develop this information and exonerate Mr. Thompson, clear him at this point, clear him before he spent any more time in jail," said Oneida County D.A. Scott McNamara.

How could this woman misidentify the man who shot her and killed her friend? The answer might lie in the police photos as Thompson bears a resemblance to Mark Anthony-Ware.

I'm a middle class white working mother of 3 and believe me-this happens to all nationalities-not just black. I have, to my disbelief, had to teach my kids that the cops are not your friends and I have also taught them not to trust cops. They lie, manipulate, and arrest innocent people all the time. And the truth of it is-you're guilty unless you have enough money to prove your innocent!!! Maybe if officers started loosing their jobs for making such "big" mistakes it wouldn't happen so often!

Please, just because they might have had his picture from a prior transgression doesn't automatically make him a usual suspect. His picture could have been from shoplifting, petty larceny, criminal mischief, etc. No, the UPD took the say so of a known junkie. They wanted a quick close to this case so they didn't have to do any real police work. On flimsy eyewitness testimony such as this, and with Omar having a solid alibi, he never should have been jailed, let alone charged.

I think that this is awful.I dont feel that probable cause is enough to arrest someone unless they feel that this person of interest is gonna flee but in this case it was clear that he was not gonna flee.He volunteered to go in for questioning.This is not the behavior of someone who is guilty.

I was in the area shopping at a Russians car dealership and witnessed it for myself the unprofessionalism and no care for a child well being! I tried to intervene with my credentials and Badge I was told to shut up or I would be arrested for disorderly conduct! Clearly that is not a legitimate charge, but I backed down fearing I would be arrested. It is a shame the UPD are like this. I am a fellow officer and have no Respect for the Department! I do respect the JOB AND CODE!

The officers on the scene were non compliant and performing in a amatuerish way! They, meaning the gradiose District Attorney, and Utica Police, did the right thing and let this guy go. I don't know Omar, but the comments regarding him by other bloggers really made you wonder if this was the right guy. I am very happy that you have been set free. It is so easy to be mistaken for someone else and then spend the rest of your life behind bars. I agree, you really don't look like the other guy, but the whole story didn't come out, like the real killer was wearing a hoodie!

I went to school with Omar! I said earlier he was innocent, I am a Police Officer in the Army of 6 years and the U.P.D. is the most unprofessional group of public safety officers I have seen. I have been to many places nationally! Take for instance 6 wks ago U.P.D responded to call on Hope and Schuyler, a 8 yr old boy was hurt badly by a 17 yr old. So the parents of the 8 yr old called the police and I witnessed the UPD harrass the father of the 8yr old and threaten to arrest him... 2bcontinued^

She is a junkie and her statements should have been taken with a grain of salt before going off and arresting the wrong guy. I thought the UPD had investigators?
