Ilion police arrest Herkimer man on rape charge

ILION (WKTV) - Ilion Police have arrested a Herkimer man for allegedly raping a 16-year-old girl.
    
21-year-old, Andrew James Reynold is charged with two counts of rape, one count of a criminal sexual act, two counts of endangering the welfare of a child, and one count of criminal contempt.
    
The alleged victim says they had been having sexual intercourse and oral sex since she was 15. 

There was also an order of protection against Reynolds that required him to stay away from the girl.  Police say he intentionally and knowingly violated the protection order.

Reynolds was arraigned in the village of ilion, and is in the herkimer county correctional facility in lieu of a $10,000 cash or $20,000 bond.  He is scheduled to be back in court December 26th.

OK classic case of let's blame the victim. Let me guess :she asked for it and was wearing provacative clothing...." I hear it everytime. He is old enough to know the law. Legally she can not consent to sex so yes it is rape. statutory rape, he knows exactly what he was doing, an older man taking advantage of a 15 year old child. So yes it is rape... statutory rape. When are these men gonna be held accountable? I am sick of people defending them!!!!!

Ok, so there are a few issues here. First the fact that this really is rape. It is Statutory Rape. Reguardless of if you believe in the law or not, it is the law. Second is the fact that this is a second offense, since there was a previous Restraining order against him. While the girl is old enough to know better, she is not old enough, by law, she is still a child. He is an Adult. Bottom line. He was told to stay away, he choose not to, he needs to pay the penalty. bottom line deal with it

This story is missing a few facts here. We can't and should not judge just on what is being reported as we do not have all the facts. What I'd like to know is if the girl may of enticed this gentleman into the contact somehow. If he acted solely on his own and tried to get back together with this young woman then he gets what he gets! A true fact here though is this is rape regardless if you read the penal law.

@anonymous - So everyone charged with rape is a sexual predator, every time, reguardless of if they are convicted yet or at all? Most likely the girl was in a consensual relationship with the man, things turned sour, and she decided to milk the states bloodlust for "predators" by using the heavy-handed Age of Consent law against him. Believe me, this is likely no moral and virtous man, but that girl has a much to answer as he does.

the thing is, I am sure that this was CONSENSUAL sex. Not that being 15 gives you the right to say yes to sex, but I am sure that he did not RAPE her. She was willing and her parents go po'ed so they charged him with RAPE. Very bad judgement on his part... think with the right head next time.. wait until she is 18

WHere was the parents a year ago when this was going on . Seems aweful strange this story , I really do not call it rape.

This is the type of situation that occurs when loving caring parents who try to teach their children the proper way to behave, beg and pled with law officials to do something before it is too late. Laws that are designed protect our young people and give them rights are the same laws that allow sexual predators to manipulate the minds and thoughts of our innocent children.
