Eminent domain causes confusion over Herkimer County Jail vote


HERKIMER COUNTY, N.Y. (WKTV) -  County lawmakers say Village of Herkimer lawmakers are confused about Wednesday night's piece of legislation about the County Jail.

County lawmakers believe the wrong information about eminent domain is being passed around. 

Herkimer Public Safety Committee Chairman Len Hendrix says the county is not taking the Pharmhouse Plaza site on Route 28 by eminent domain. Hendrix says instead that all of Wednesday's legislation does identify the land as the site the county wants to build the future jail on.
"This is about as basic as you can get. This is very early. We identified a site and were looking to go further with that site. But it is an extremely preliminary step," said Hendrix.

Hendrix says all Wednesday's legislation will do is allow for the county attorney to lock into a contract with the engineering and consulting company about the Route 28 site.
If the legislation is passed, the consulting company can then go ahead and start a water and sewer study of the land and draw up schematics of what a future jail would look like.
"I would say this would be as close to as far on in any site we have been. As far as locking in a consultant for a particular purpose."
