Court of Appeals: State has final say on NYRI

(WKTV) - The United States Fourth Circuit Court of Appeals has decided that if New York State rejects the New York Regional Interconnect power line application, the federal government can not override the state and approve the application. 

The Federal Commission could still appeal the decision.

U.S. Senator Charles E. Schumer released the following statement:

"This is the victory we have been waiting for. This decision puts the kibbosh on NYRI's effort to do an end-around local law and correctly determines that New York State should have the preeminent role in siting projects like NYRI."

Schumer went on to say:

"NYRI's proposed path remains unduly intrusive and would have damaging impacts on parks, vista and communities from Utica to Chenango to the Catskills to Orange County."
