Madison County says 'no deal' to Oneida Indian Nation
WAMPSVILLE, N.Y. (WKTV) - Madison County leaders have had extensive negotiations with the Oneida Nation in an effort to hammer out their own agreement with the Nation. So far, no deal. "The proposal was rejected," said Madison County Board of Supervisors Chairman John Becker of one offer by the county last spring. "The cities of Sherrill, Oneida, National Grid and most recently Oneida County have all sat down and hammered out agreements with the Oneida Nation. Madison County is the only group that has not been able to reach an agreement. For this to work, you have to want to move forward together rather than litigate the issue for years to come," says Nation Spokesperson Mark Emery. Madison County has a court date in Albany next month regarding land issues. "There is a motion for summary judgment going to be argued before Judge Kahn in Albany June 19 where we've identified a number of issues relating to land to trust and why we believe it's not available in the state of New York," says Madison County Attorney John Campanie. As far as Oneida County's proposed Partnership Plan with the Oneida Nation, Madison County leaders say it leaves many major areas of concern either unaddressed, or inadequately addressed. Among them: failure to include settlement of the land claim; the need to assure finality, including a Congressionally-approved binding cap on trust lands; the proposed permanent exemption fro sales and excise tax of all sales by Indian retailers to non-Indians, and finally, the non-revocable, non-discretionary deputization of members of the Oneida Indian Nation Police force. Oneida County Executive Anthony Picente, Jr. says some of these issues aren't even under county jurisdiction. "Have congress put legislation in that deals with trust in its entirety. Again I dealt with what's in front of me as a local issue. Now it's up to the other levels of government to step up and stand up for courage and do what's right and address trust land." Madison County leaders are still determining what, if any, effect the Oneida County Partnership Plan will have on their bargaining position with the Oneida Nation. |
