UTICA, N.Y. (WKTV) - It is still unclear whether the city of Utica's new police chief scored higher on the civil service test for the job than the two deputy chiefs who also took the exam. Although passing scores are public record, city officials have not been forthcoming in releasing them.

On Tuesday, when asked who out of LaBella, Deputy Chiefs Michael Bailey and Mark Williams scored highest on the test, Mayor David Roefaro directed reporters to the city's civil service department.

A Freedom of Information Law request to that department from NEWSChannel 2 has not been answered.

By law, the city has five days to respond to the request. However, NYS Committee on Open Government Executive Director Robert Freeman says he cannot understand the reason for the delay of disclosure when the information sought is public record, and easily accessible.

"Today was the day of reckoning, today was the day we decided and we have all the scores today," Mayor Roefaro said on Tuesday.
