HERKIMER, N.Y. (WKTV) - Herkimer's Police Chief wouldn't say if the two-week inventory of the department's evidence room revealed any more missing money, but Chief Joseph Malone did meet Tuesday about the completed inventory with Herkimer County District Attorney John Crandall.
Officials had to survey the evidence room after one of their own -Investigator Robert Risi - was charged last month with stealing more than $9000 from the department's evidence room.
D.A. Crandall has the added responsibility of reviewing all pending criminal cases that former Investigator Risi worked on, and determining if they can go forward.
"As the cases come up, we review them to determine how we're going to handle the prosecution. It has already affected a couple of cases I would say and I don't know how many more it will," says Crandall.
The D.A. has already heard from defense attorneys regarding Risi's strained credibility.
"Attorneys have already raised issues concerning his involvement in specific cases and how his credibility or lack of credibility will bear on our effective prosecution of the case."
Depending on how much of the cases in question hinge on Risi as a witness will determine if they can even go forward.
"If he's the only witness, we'd have to look at whether it's prosecutable or not; that's as far as I can go," says Crandall.
More could soon be known about whether Risi could face additional charges; all parties are due in Herkimer County Court on Thursday for a pre-trial conference, or status update on this case.
"If he's the only witness, we'd have to look at whether it's prosecutable or not; that's as far as I can go," says Crandall.
