UTICA, N.Y. (WKTV) - Prosecutors were hoping to see him in a local courtroom Wednesday, but a mix-up in New Jersey has delayed the arrival of the fourth and final suspect waiting to be brought to justice in the murder of New Hartford Police Officer Joseph Corr.

Robert Ward had a hearing in New Jersey and after it, police brought him back to the Essex County jail instead of state prison.

Oneida County Marshals can only retrieve him from a state prison facility.

A New Jersey judge has yet to issue an order for his transfer back to state prison. And since local prosecutors want to try Ward and suspect Marion Pegese together, and Pegese has been back around a month - the clock is ticking.

"The statute, the temporary custody statue, the IAD Statute requires that we go to trial within four months of the individual arriving in New York," said Matthew Worth, the prosecutor in the case.

Prosecutors hope to know more Thursday about when Ward might be back in state prison.
