Seymour and James is becoming an all too familiar corner for Utica Police

By WKTV News

UTICA, N.Y. (WKTV) - Sunday night, officers were called there once again for yet another fight taking place between young people.  This fight comes just five days after police were called there for another fight, that actually turned into what they call a "gang attack".  Someone from the area caught it all on videotape, and on Wednesday it was posted to the internet website, Youtube.

The video shows two young males in an argument, one throws a punch and the two get into a pushing and shoving match.  Well, a short time later, several other young males join in on the attack on the male that threw the first punch.  Police were called to the scene, but got there after the incident was over, and no one pressed charges, so no arrests were made.  Now Deputy Chief Michael Bailey says the video is the focus of an ongoing investigation.

Bailey told NEWSChannel 2 on Sunday, "it very quickly gets out of hand and becomes essentially a gang assault....and it's important to remember this isn't entertainment, this is a crime, and it's under investigation, it's an active investigation, the issues then become, it's great it's on Youtube, but you still need people to come forth and give statements, you need a victim who says yea, I want to press charges, short of that, this is a video on Youtube."  Bailey adds, "this is just a piece of evidence, if there are police officers that witnessed this on the street that are there, you can immediately start arresting people for a variety of things, possession of weapons and disorderly conduct, those kinds of things, when we're not there and we're called after the fact, it becomes an investigation, you need probable cause to make arrests with the cooperation of the victim.

So far no word on whether there have been any arrests made in that fight, or the fight reported at Seymour and James this evening.  We hope to have more for you on this story on Monday.
