Mohawk Central School District agrees to protect gay student

MOHAWK, N.Y. (WKTV) - A week after the New York Civil Liberties Union filed a federal lawsuit against the Mohawk Central School District for failing to protect a gay student from harassment by classmates, NYCLU officials now say the school district has agreed to take immediate action to ensure Jacob's safety when school resumes in a few weeks.

Exactly what steps the district will take to protect Jacob are not known, as the agreement, which was approved by a federal judge, is under seal.

NYCLU officials say the agreement does not end the lawsuit.

"We will pursue our lawsuit until the Mohawk Central School District makes the long-term solutions necessary to ensure that all students are safe at school and treated with the dignity and respect they deserve,"  says NYCLU Executive Director Donna Lieberman.

"...I am happy to announce that the parties have agreed to a plan which settles the preliminary issues associated with the lawsuit.  This allows for a mutually agreed upon approach to address the unique circumstances surrounding the preliminary issues of this case,"  says Mohawk School Superintendent Joyce Caputo. Caputo, however, takes exception to the NYCLU's assertion that the district is caving to their "demands".

"The NYCLU has issued a press release claiming that the District has agreed to its 'demands.'  In fact, the vast majority of the measures that the District has agreed to were already in place during the last school year and are being implemented because they are appropriate to the circumstances and not because the NYCLU demanded them."
