How did Smajic still get votes?

UTICA, N.Y. (WKTV) - Less than 12 hours ago, a candidate whom a court decision had forced off the ballot in Utica's First Ward Council race appeared to have a commanding lead.

How did that happen? Oneida County election officials say that, while Nedzad Smajic's name was removed from the ballot, it wasn't removed from the computer system that compiles results, "when the data was compiled within our data system itself, the name on the ballot wasn't changed. So in the computer's mind, we were still dealing with Mr. Smajic, not Mr. Vescera," says Oneida County Republican Election Commissioner Pamela Mandryk.

Election officials say it's basically like a clerical error with no real impact. Everyone voted for whom they thought they did. No one thought they voted for Smajic, as his name wasn't even on the ballot.
