Little Falls man sentenced for second time in two days for rape charges

HERKIMER, N.Y. (WKTV) - A day after he was sentenced in Oneida County Court to 25 years in state prison for rape, 44-year-old David Lipiec of Little Falls was sentenced in Herkimer County Court for kidnapping and possession of prison contraband. He'd pleaded guilty to both.

Tuesday at Lipiec's sentencing, Herkimer County Assistant District Attorney Jeffrey Carpenter read a statement written by the victim in this case. Lipiec was accused of forcing her into his car as she walked along Route 5 during the early morning hours of March 1st.

"I am humble in stating that I, although I did not suffer nearly as much as what they went through, am standing with these women and fighting back.....

...I use this statement to show my appreciation for everyone involved getting this man into prison and as a method of laughing in the face of a man who thinks he can get away with raping and kidnapping a person with the intention of doing it again and again," read Carpenter.

Herkimer County Court Judge Patrick Kirk expressed disappointment that Lipiec chose not to make any statements to the victim in this case. Kirk sentenced Lipiec to 25 years in prison. That sentence will run concurrently with the 25-year sentence Lipiec received Monday in Oneida County Court, which means he will serve 25 years, total.
