Jury deadlocked in Nappi trial

HERKIMER, N.Y. (WKTV) - The jury is hung in the trial of Donato Nappi who was accused of violating his parole in a 1980 murder.

A unanumous verditct is required in civil cases, and that was not reached Friday. A new jury must now be drawn. Nappi must also face a parole board hearing. No word yet on when that will be.

Donato Nappi is a paroled murderer convicted of killing Dawn Grillo in 1980. Last January he was arrested on gun possession charges and is facing a criminal count of possession of a weapon.

The jury of eight women and four men deliberated for about three hours on Thursday and returned Friday at 10:00a.m. Around 10:45, the jury took a break and asked for a re-read, asking for the definition of reasonable doubt and credibility

This is the second re-read the jury has asked for. Thursday night, they asked for a re read of Janice Nappi's testimony. Janice Nappi is the wife of Donato Nappi and the one who tipped off authorities he was in possession of a gun.

If convicted, Nappi could have faced up to seven years in prison.
