Plaintiffs in bar fight drop notice of claim against Utica and police department; go after alleged assailants

UTICA, N.Y. (WKTV) - The case of a notice of claim a Utica couple filed against the city of Utica, the police department and several officers has gone away.

In May, Cynthia and Carmine Amarosa filed the notice, claiming that several off-duty police officers did nothing to protect them during a fight at Shorty's Sports Bar and Grill in South Utica.

However, the alleged incident happened in September of 2008. City attorneys say the statute of limitations on the case has expired and therefore it's too late for an actual lawsuit.

The Amarosa's attorney said that after speaking with his clients and investigating details of the case, they decided instead to go after the individuals who allegedly attacked the couple, and not the city and its police department.
