Driver involved in fatal tractor trailer accident issued tickets

DAVENPORT, N.Y. (WKTV) - A Binghamton man has been ticketed following the fatal tractor trailer crash that killed a woman after crashing into her home.

On February 19, 2010, at approximately 5:03 a.m., a 1995 Freightliner tractor towing a flatbed trailer was traveling east bound on State Route 23 in the Town of Davenport, driven by Charles J. Harford, 61, of Binghamton.

State Police said Harford failed to negotiate a sharp left-hand curve entering the hamlet of Davenport Center, when the vehicle exited the roadway on the east shoulder, and struck a single story residence and a vehicle parked at 10758 State Route 23.

The tractor trailer was hauling a load of concrete forms which became dislodged from the trailer and entered the residence. The impact of the vehicle and cargo destroyed the front portion of the residence and interior.

Asleep in the residence at the time was Rhonda Hitchcock, 47, who was killed by the dislodged concrete forms. Two additional occupants of the residence, a woman and a five year-old child were injured with non-life threatening injuries, and were taken to area hospitals, along with the operator of the tractor trailer and a passenger.

On February 27, 2010, State Police issued Charles J. Harford uniform traffic tickets for the following violations under the Vehicle and Traffic Law and Transportation Law:

Vehicle & Traffic Law
Failure to Use Seat Belt - Driver
Speeding - Speed Too Fast For Conditions
Improper Lane Usage

Transportation Law
No Drivers Record of Duty Status - No Log Book
Brakes out of Service - Trailer
Insufficient Load Securement
