NORWICH, N.Y. (AP) - A 38-year-old man whose conviction for killing his wife was overturned on appeal has been indicted again for her murder and will face a new trial.

Peter Wlasiuk of Oxford was scheduled to be arraigned today in Chenango County Court in the 2002 death of his 35-year-old wife, Patricia.

Wlasiuk has been in the Chenango County jail without bail since last August, when the Appellate Division of state Supreme Court ordered a new trial. The court ruled that the presiding judge erroneously allowed testimony of his prior violence against his wife.

A Chenango County Court jury convicted Wlasiuk of killing his wife and staging it to look like a traffic accident.

Wlasiuk initially said his wife had swerved to avoid a deer and then drowned when their pickup truck crashed into Guilford Lake, 65 miles southeast of Syracuse. Later, he told authorities his wife intentionally drove into the lake.
