UTICA, N.Y. (WKTV) - Troubled landlord Timothy Klotz has agreed to tear down his property at 102 James Street within the next 30 days.

Klotz and his brother, Richard Klotz, were due in Utica City Court Tuesday for a hearing regarding 102 James Street where Judge Ralph Eannace would hear arguments from both Klotz brothers and city attorneys. Judge Eannace would then decide if and when the building needs to come down, or, if it can be rehabilitated.

It's not yet clear whether Judge Eannace will immediately rule from the bench, or reserve decision until a later date. As of noon today, the hearing had not yet begun.

102 James Street is the site of a fatal fire in September 2009, where four people died.
