Blainey parole hearing paves the way for murder case
UTICA, N.Y. (WKTV) - A parole hearing has been scheduled for the re-captured serial rapist who allegedly killed a Utica motel owner.
Robert Blainey will go before an administrative law judge on Monday, November 28 at the Oneida County Jail, where he's currently being held on that parole violation.
Officials with the New York State Division of Parole say the hearing could take five minutes, or it could take two hours. It will involve Blainey, his attorney, the judge and a parole revocation specialist.
The Oneida County District Attorney's Office plans to take the murder of Davis Motel owner Linda Turner to a grand jury for a possible indictment against Blainey and they may attempt to charge him with first-degree murder.
If found guilty of violating his parole, the judge may place a parole hold on Blainey, putting him back in jail for a certain period of time. Once the parole matter is cleared up, the murder case against Blainey can proceed.
