C.O. to return to court in August on final charge in assault case

UTICA, N.Y. (WKTV) - The lawyer for a former state correction officer recently found not-guilty of assaulting an inmate met with with prosecutors and the judge on Wednesday.
The meeting came after an Oneida County jury came back deadlocked on one of the three charges, a misdemeanor, against Michael Wehby on June 18. The jury found Wehby not-guilty on two felony charges of assault.
He was accused of severely beating up inmate Jose Rivera at Midstate Correctional Facility in January 2010.
Wehby and his attorney will return to Oneida County Court on August 6 to report on an offer. If the charge is not disposed of on that day, a new trial will begin for Wehby on that specific charge on September 17.
