ROCHESTER, N.Y. (WKTV) - Adam Theall's appeal was denied in the appellate division court in Rochester, meaning his conviction is upheld.

The father shot and killed his infant son back in June of 2010. He admitted to placing the baby over the barrel of a shotgun and pulling the trigger.

In spite of his guilty plea, Theall tried to appeal the case, claiming the judge did not adequately explain the intoxication defense.

The case was argued in the appellate division in Rochester.

Theall's conviction to 25 years in prison to life is upheld.
