DPW worker struck by vehicle on Herkimer Road in Utica

UTICA, N.Y. (WKTV) - A Utica DPW worker is recovering from several broken bones and internal injuries after being hit by a car early Monday morning.

Police say the driver who hit him has now been charged under the "move over" law.

Rocco LaBella, 52, was stopped on the side of Herkimer Road with amber lights flashing and wearing a reflective vest around 2 a.m. Monday morning.

Police say a van driven by Robert Newman, 45 of Utica struck LaBella, sending him to the hospital with non-life threatening injuries.

Newman has been issued a summons for failing to yield to a DPW worker, otherwise known as the Move Over Law.
