HERKIMER, N.Y. (WKTV) - A state appellate court has shortened the prison sentence of a former Herkimer County restaurant owner who was convicted last year of raping a dinner guest.

Isidoro Marra, 62 was initially sentenced to 18 years for first-degree rape followed by 15 years of supervision. Friday, the Appellate Division of the Fourth Department out of Rochester reduced Marra's sentence to 10 years with 5 years of supervision.

Marra was the owner of the Villa Isidoro in Richfield Springs.

The appellate panel cited Marra's age and lack of a prior criminal record as well as insufficient evidence for the reduced sentence.
