Former Waterville teacher sentenced three years in sex crime
UTICA, N.Y. (WKTV) - A former Waterville teacher accused of abusing a young student heard his sentence on Wednesday in Oneida County Court.
In May, a jury found David Lemery guilty of second-degree course of sexual conduct against a child and not-guilty of the same crime in the first-degree. The now-19-year-old victim was in court on Wednesday, but didn't wish to speak. Instead, the prosecutor read a statement she had written.
"What was done to me was wrong and so unforgivable. How can someone ever take advantage of a small child is so beyond my understanding. It takes a sick and twisted individual to do these things to a child," said Prosecutor Dawn Catera Lupi, reading the victim's letter.
Lemery himself chose not to speak at his sentencing, but his attorney read a letter written by Lemery's wife, defending him and singing his praises as a father.
Lemery could have received up to seven years in state prison, but the judge sentenced him to three years.
