Hate crime designation to be added to man's assault charge

(WKTV) - A 33-year-old Florida man who has been charged with assault in Herkimer has a pending warrant against him for assault in the third degree with a hate crime, according to Herkimer County District Attorney Jeff Carpenter.

Stephen Gilligan, 33, of  New Port Richey, Fla., is accused of assaulting a victim on North Main Street in Herkimer on March 5.

Gilligan allegedly began shouting slurs at the victim based on what he was wearing at the time before assaulting him. To have a hate crime designation added to a charge, there must be a real or perceived notion about someone's race, gender, sexual orientation or religion, and that belief causes someone to choose an action against a victim, Carpenter said.

When Gilligan is arraigned in the Village of Herkimer Court, the hate crime will be added to his assault charge, Carpenter said.
