Herkimer man accused of stealing gas from state-owned facility

A Department of Transportation highway maintenance worker was arrested Monday on charges he stole gasoline from a state-owned facility in Utica, New York State Inspector General Catherine Leahy Scott announced.

William Gallagher, 42, of Herkimer, is accused of using a state card to purchase gasoline for his own personal use. Gallagher is charged with six counts of offering a false instrument for filing, which are Class E felonies, and six counts of misdemeanor petit larceny, officials say.

According to the inspector general's office, surveillance cameras showed Gallagher filling the tank of his personal vehicle on five occasions and a gasoline on one occasion between January and March 2013.

Gallagher was arrested and arraigned Monday at Utica City Court before Judge John S. Balzano. He is set to return to court on Oct. 13.

Gallagher has been employed by NYSDOT since September 1999.
