Kelly Marshall sentenced to 19 years to life for Olbiston murder

UTICA, N.Y. (WKTV) - A Utica woman was sentenced Wednesday for murder in the stabbing death of Allen Minor of Utica. Kelly Marshall will spend the next 19 years to life in state prison for her guilty plea for her role Minor's death.

Marshall, and recent parolee Dennis Moseley were charged with Minor's death in March of 2013.

Police said the pair stabbed Minor to death in his Olbiston Apartments home, and stole his money to buy drugs.

In court the prosecutor said Marshall's choices demonstrate that her criminality is not decreasing over time, but escalating.

Marshall apologized through tears for her role in victim Alan Minor's murder. She did not ask for mercy, rather threw herself to the mercy of the court, saying she's ready to do the time.

"I'm sorry and if I could bring him back I would and... I'm sorry that my drugs took over my problem," Marshall said.

Marshall's co-defendant, Dennis Moseley, of Albany. is in a psychiatric hospital after a judge this summer found him to be an incapacitated person, incapable of assisting in his own defense. He will be periodically re-evaluated.
